1) Scope of Application

1.1 These Terms and Conditions (GTC) of BG Investment GmbH (hereinafter referred to as “Seller”) apply to all contracts between a buyer (“Client”) and the Seller regarding goods and/or services presented in the Seller’s online shop. The Client’s own terms are excluded unless expressly agreed otherwise.

1.2 The use of the Seller’s website by the Client signifies agreement to these GTC.

1.3 The Seller may modify these GTC at any time. Clients will be notified of significant changes at least 30 days in advance. Continued use of the Seller’s online shop after modifications indicates acceptance of the revised GTC.

1.4 The Client agrees to electronically receive, sign, and authenticate documents under the E-SIGN Act, UETA, and applicable state laws. Electronic signatures carry the same legal weight as ink signatures. Documents may be retained in electronic format as transferable records.


2) Conclusion of the Contract

2.1 Product descriptions in the Seller’s online shop are not binding offers but serve as invitations for the Client to submit an offer.

2.2 The Client may place an order via the Seller’s online shop by adding goods/services to the virtual cart and completing the checkout process. Submitting the order constitutes a legally binding offer.

2.3 The Seller may accept the Client’s offer within five days by:

  • Sending an order confirmation (via fax, email, or in writing); or

  • Shipping the ordered goods; or

  • Requesting payment from the Client.

If none of the above occurs within five days, the Client’s offer is deemed rejected.

2.4 The acceptance period begins the day after the Client submits an offer and expires after five days.

2.5 The Seller will store the contract terms and send them to the Client via email, fax, or letter after order submission. The contract text is not retrievable from the Seller’s website post-order completion.

2.6 The Client may review and correct input errors before submitting the order using standard keyboard and mouse functions.

2.7 The contract language is English.


3) Return Policy

The Client has 30 days from receiving an item to request a return.

To initiate a return, contact us at support@pethomegear.com. If approved, we will provide a return shipping label and instructions. Returns sent without prior request will not be accepted.

Certain items, such as sale items and gift cards, are non-returnable.

Eligible returns must be in original condition, unused, with tags, and in original packaging, along with proof of purchase.

For damages or issues, please inspect items upon receipt and report defects immediately.

Refunds are processed within 10 business days after approval. If 15 business days have passed without refund receipt, contact support@pethomegear.com.


4) Price and Delivery Costs

4.1 Prices are listed in USD, excluding taxes and shipping costs, which the Client must bear. In case of pricing errors, the Seller will either charge the lower price or cancel the order if the correct price is higher.

4.2 For U.S. deliveries, additional costs like bank transfer fees, taxes, and customs duties apply. The Client bears these costs.

4.3 Payment methods are listed in the Seller’s online shop.


5) Shipment and Delivery Conditions

5.1 Goods are shipped to the address provided by the Client unless otherwise agreed.

5.2 If an item is unavailable, the Seller will notify the Client and offer an alternative or cancellation with a refund.

5.3 If delivery fails and the transport company returns the goods, the Client bears the cost of the failed shipment.


6) Warranty

The Seller disclaims implied warranties of merchantability and fitness for a particular purpose. Liability for indirect, special, or consequential damages, including lost profits, is excluded. The Seller’s maximum liability is limited to the amount paid by the Client for the goods/services.

Some jurisdictions do not permit warranty exclusions, in which case limitations apply only to the extent allowed by law.


7) Limitation of Liability Regarding the Use of the Seller’s Online Shop

7.1 Use of the Seller’s website is at the Client’s risk. The site is provided “AS IS” and “AS AVAILABLE,” with no warranties of accuracy, reliability, or uninterrupted access.

7.2 The Seller is not responsible for viruses or damage resulting from website use or downloads.

7.3 External links on the Seller’s website may lead to third-party sites. The Seller is not responsible for their content, accuracy, or privacy policies.

7.4 Some jurisdictions do not permit certain liability exclusions, in which case limitations apply only as allowed by law.


8) Limitation of Action

No claim related to this contract may be initiated more than 12 months after its basis was discovered.


9) Governing Law

This agreement is governed by the laws of Illinois, excluding the UN Convention on Contracts for the International Sale of Goods.


10) Designation of Forum

Legal actions related to this agreement must be filed in the courts of the state where the Seller’s business is located. Both parties consent to this exclusive jurisdiction.
